Subdivision Ordinance Update

In 2023 the State Legislature changed the regulations for how jurisdictions can process and approve subdivision applications. Cities like Draper were given until February 1, 2024, to comply with these new State requirements. As part of making these changes, the City Council adopted changes to our subdivision ordinances on January 16, 2024. Residents should be aware that the new changes will affect how and when they receive notification for Public Meetings or Public Hearings regarding subdivision applications and the approval process for subdivisions.

Preliminary Plat applications will now be presented to the Planning Commission for approval at a Public Meeting, which does not allow for public comment. Notice of the Public Meeting will be provided on the City’s Agenda webpage and on the Utah Public Notice Website.

Final Plats and applications for Minor Subdivisions (10 lots or less) without deviation requests will be approved by the Zoning Administrator. A Public Meeting or Hearing will not be held. The approval notice will be posted on the Community Development Department’s webpage for Administrative Decisions.

Minor Subdivision applications that include Deviation requests will be presented to the Planning Commission for approval at a Public Hearing, which allows for public comment to be taken at the hearing. Notice of the Public Hearing will be provided on the City’s Agenda webpage and on the Utah Public Notice Website and will be mailed to property owners within 300 feet.

Subdivision Plat Amendment applications will be presented to the Planning Commission for approval. This could be at a Public Meeting or a Public Hearing depending upon the specific circumstances of the application. Notice will be provided in the same manner as for Minor Subdivision applications with deviations. The notice will specify whether it will be a Public Hearing or a Public Meeting.
